Kim Ross K.C.’s Recent Successful Bail Hearings

In Canada, everyone has a right to be considered for bail. However, this is not an easy task as the availability of bail varies significantly depending on an accused person’s charges. The difficulty is further increased if the accused is on other forms of release, or any of the other issues which can arise during criminal trials. There are often a number of avenues to securing bail: imposing conditions such as curfew or house arrest, surety with promises to pay, or electronic monitoring. Choosing the right conditions for a client is complex and requires specific attention tailored to each client's situation.

Kim Ross has been advocating for his client’s bail rights this week. In three matters, Kim was able to secure bail in opposed hearings in the Court of King’s Bench.

In the first hearing in the Court of Justice, Kim succeeded in his show cause, for a charge of attempted murder, which involved electronic monitoring and the naming of a surety. Despite the apprehensions of prior counsel over the difficulty of securing release, Kim was able to get his client bail in the Court of Justice. The matter is now set for a King’s Bench judge and jury trial after the Crown elected to proceed by indictment. The trial will take place in December 2027.

For his second appearance, Kim client was ordered detained in the Court of Justice and after a bail review in King’s Bench was released with strict conditions including a curfew and a surety. There was an allegation of a breach which resulted in a re-arrest. Kim was back in court within 12 hours to renew this client’s release.

In another matter, Ross returned to the Court of King’s Bench to secure another release for a client charged with aggravated assault, possession of firearms, and attempted murder. Despite the severity of these offences, Kim has been able to keep this client’s conditions to a minimum. A preliminary hearing is scheduled for the end of October 2026.

A successful bail hearing, especially in the Court of King’s Bench, is just one step in the long road of trial. Kim’s diligence, courtroom experience, and advocacy skills have helped his clients time become more bearable in the criminal justice system.
